The rules for listings, applications, enquiries and your use of the platform.

This Acceptable Use Policy sets out the standards that govern your use of the platform operated by The Secretary (Pty) Ltd, and in particular the content you submit to it - including property listings, job vacancies, job applications, enquiries and contact messages. It applies in addition to, and forms part of, the agreement between you and us recorded in our Terms & Conditions.

By accessing or using the platform, or by submitting any content to it, you agree to comply with this Policy. If you do not accept it, you must not use the platform or submit content. Words and expressions defined in the Terms & Conditions have the same meaning in this Policy unless the context requires otherwise.

1.Scope and Application

This Policy governs all use of the platform and all material in any form that you upload, post, submit, transmit or otherwise make available through it (together, your "content"). It should be read together with the documents cross-referenced in the section headed Related Policies.

1.1

This Policy applies to every person who accesses or uses the platform, whether as a registered account holder, a guest, a visitor, an advertiser of vacancies or property, a job applicant, an enquirer or a service recipient.

1.2

This Policy applies whether you use the platform on your own behalf or on behalf of another person or organisation. If you act for another person, you confirm that you are authorised to bind that person to this Policy and that you and that person are jointly and severally responsible for compliance with it.

1.3

We may amend this Policy from time to time. The version published on the platform at the time you use it is the version that applies to that use, and your continued use after a change takes effect constitutes acceptance of the amended Policy.

2.Your Responsibilities When Submitting Content

You are responsible for everything you submit through the platform and for ensuring that you are entitled to submit it. Before you post any listing, vacancy, application, enquiry or message you confirm to us that the following are true.

2.1

You have the authority and all rights, licences, consents and permissions necessary to submit the content and to grant us the right to host, review, publish, display, edit and remove it in accordance with the Terms & Conditions and this Policy.

2.2

The content is accurate, current, complete and not misleading; where it advertises property or a vacancy, it genuinely reflects the property or position offered, and the price, terms and material particulars are correctly stated.

2.3

The content is lawful and complies with all applicable laws of Botswana, including the Data Protection Act, 2018, the Electronic Communications and Transactions Act, 2014 and the Consumer Protection Act, 2018, and does not infringe the rights of any other person.

2.4

Where the content includes personal information about any other person, you have a lawful basis under the Data Protection Act, 2018 to provide it to us and to have it processed for the purpose for which you submit it, and you have given any notice and obtained any consent required for that purpose.

2.5

You acknowledge and accept that certain content is, by the nature of the service, shared with third parties: a job application (including the applicant's name, contact details, curriculum vitae and any cover letter) is made available to the relevant employer that posted the vacancy, who becomes a separate recipient and controller of that information; and a property enquiry (including the enquirer's name, contact details and message) is made available to the lister or agent concerned. You confirm that any content you submit is given on that understanding.

2.6

You will keep your content up to date and will promptly correct or ask us to remove any listing, vacancy or other content that has become inaccurate, has been withdrawn, or is no longer available or available on the stated terms.

All listings are reviewed before publication

Property listings and job vacancies are reviewed by us before they are published. Review is a discretionary quality and compliance check; it does not amount to verification, endorsement or approval of the content, and it does not relieve you of your responsibility for the accuracy and lawfulness of what you submit.

3.Prohibited Content and Conduct

You must not use the platform, and must not submit any content, in any of the ways described below. This list is illustrative and not exhaustive of the conduct we regard as unacceptable.

3.1

You must not post any listing, vacancy, enquiry, message or other content that is unlawful, fraudulent, deceptive, or false or misleading, including fictitious property or vacancies, bait advertising, or misrepresentation of price, ownership, availability, qualifications or terms.

3.2

You must not post content that infringes any third party's intellectual property, confidentiality, privacy, publicity, contractual or other rights, including copying photographs, text, branding or particulars that you are not entitled to use.

3.3

You must not advertise any vacancy, or impose any condition, that discriminates against applicants on a ground prohibited by the law of Botswana, or that is otherwise contrary to applicable employment and equal-treatment law.

3.4

You must not submit content that is harassing, threatening, abusive, defamatory, obscene, hateful, indecent or otherwise harmful, or that incites or facilitates unlawful conduct.

3.5

You must not post or transmit the personal information of any other person without a lawful basis to do so under the Data Protection Act, 2018, and you must not collect, store or use personal information obtained through the platform - including the details of an applicant, enquirer or other user disclosed to you through the service - for any purpose other than the one for which it was provided.

3.6

You must not upload, transmit or distribute any virus, worm, malware, malicious code or other material that is designed to or may damage, disrupt, interfere with or gain unauthorised access to the platform, our systems or any user's device or data.

3.7

You must not scrape, harvest, crawl, index, data-mine or otherwise extract content or personal information from the platform by automated or systematic means, nor reproduce or republish any part of the platform, except as we expressly permit in writing.

3.8

You must not attempt to gain unauthorised access to, probe, scan or test the vulnerability of, or breach or circumvent any security, authentication or access-control measure of, the platform or any system or network connected to it.

3.9

You must not take any action that imposes, or may impose, an unreasonable or disproportionate load on the platform or its infrastructure, including denial-of-service activity, flooding, or automated request generation.

3.10

You must not send spam or unsolicited communications, misuse the contact, enquiry or application channels, impersonate any person, or use the platform to advertise or solicit business outside its intended purpose.

3.11

You must not interfere with the passwordless magic-link sign-in or any other feature, tamper with order amounts or other server-controlled values (all orders being re-priced by us on the server at checkout, so that any amount you attempt to substitute has no effect), or use the platform in any way that is intended to defeat its proper operation.

3.12

You must not use the platform's AI assistant, or any content it generates, in an attempt to extract another person's personal information, to circumvent this Policy, or for any unlawful or prohibited purpose; the assistant is provided to help answer questions and does not make any solely-automated decision that produces legal or similarly significant effects about any person.

4.Our Rights of Review, Refusal and Removal

We operate the platform and decide what content appears on it. The following rights are in addition to any other right we have under the Terms & Conditions or at law.

4.1

We may review, screen, moderate, refuse, edit, withhold, delay, suspend or remove any content, in whole or in part, at any time and at our discretion, with or without notice and with or without giving reasons, including where we consider that content may breach this Policy or any applicable law.

4.2

We are under no obligation to publish any content, and review of a listing or vacancy before publication does not oblige us to publish it or to retain it once published.

4.3

We may suspend, restrict, or terminate your access to the platform or your account, temporarily or permanently, where you breach this Policy or where we reasonably consider it necessary to protect the platform, other users or any third party.

4.4

Where it is lawful and practicable to do so, and the matter is not urgent and does not involve suspected unlawful conduct, we will endeavour to give you notice of, and an opportunity to address, a concern about your content before we act on it.

5.No Endorsement of User Content

Content submitted by users is the responsibility of the user who submits it, and not of The Secretary.

5.1

We do not endorse, adopt, verify, guarantee or accept responsibility for any user content, including the existence, ownership, condition, legality, suitability, accuracy or availability of any property advertised, any vacancy, or any statement made by any user.

5.2

Any dealing you have with another user - including a lister, agent, advertiser, employer, applicant or enquirer - is between you and that user. We are not a party to it and, to the fullest extent permitted by the law of Botswana, accept no responsibility or liability for it, save to the extent that liability cannot lawfully be excluded.

Limits that cannot be excluded

Nothing in this Policy excludes or limits any liability that cannot lawfully be excluded or limited under the law of Botswana, including liability for fraud or fraudulent misrepresentation, liability for death or personal injury caused by negligence, and a consumer's non-excludable statutory rights under the Consumer Protection Act, 2018, all of which are preserved.

6.Consequences of Breach

A breach of this Policy is a breach of the Terms & Conditions. We may take any action we consider appropriate to respond to it.

6.1

Action we may take includes removing or editing content; issuing a warning; suspending, restricting or permanently terminating your access or account; and declining to provide services to you.

6.2

Where we consider that content or conduct may involve a criminal offence or a breach of law, or where we are required or permitted to do so by law, we may report the matter to, and disclose relevant information to, the Botswana Police Service, the courts of Botswana, the Information and Data Protection Commission, or any other competent regulatory or law-enforcement authority in Botswana.

6.3

You remain responsible for, and agree to indemnify us against, the losses, costs, claims and liabilities arising from your breach of this Policy, on the basis and to the extent set out in the Terms & Conditions.

6.4

Our exercise, or failure or delay in exercising, any right under this Policy does not waive that right or any other right available to us.

7.Reporting a Violation

We want to know about content or conduct on the platform that may breach this Policy.

7.1

If you become aware of any listing, vacancy, application, enquiry, message or behaviour that you believe breaches this Policy or any law, please report it to us using the contact details published on the platform, giving enough detail to allow us to identify and assess the content or conduct concerned.

7.2

We will review reports we receive and take any action we consider appropriate. We are not obliged to act on every report, to act in any particular way, or to inform the person reporting of the outcome, and our decision on any report is final, save that nothing in this clause affects any right you have to complain to a competent authority.

7.3

Concerns about how personal information is handled may also be raised with us, and ultimately with the Information and Data Protection Commission, as described in our Privacy Notice.
